ClickVault respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we respond to notices of alleged copyright infringement.

Important: This page describes the procedures for submitting copyright infringement claims and counter-notifications. Misrepresentations of infringement may result in liability for damages.

1. Reporting Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible through ClickVault, please notify our designated Copyright Agent as specified below.

Requirements for a Valid DMCA Notice

To be effective, your infringement notification must include the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material
  4. Your contact information, including address, telephone number, and email address
  5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner

2. Counter-Notification

If you believe that your content was removed in error, you may submit a counter-notification. This must include:

  1. Your physical or electronic signature
  2. Identification of the material that has been removed and its location before removal
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake
  4. Your name, address, telephone number, and consent to the jurisdiction of federal court
  5. A statement that you will accept service of process from the party who submitted the original infringement notification

Legal Consequences

Be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing or was removed by mistake may be subject to liability.

3. Repeat Infringers

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights. We maintain a record of all infringement notices and may use this information to identify repeat offenders.

4. Content Removal Process

When we receive a valid DMCA notice:

  1. We will promptly remove or disable access to the allegedly infringing material
  2. We will notify the user who posted the material
  3. If we receive a valid counter-notification, we may restore the material within 10-14 business days unless we receive notice that a legal action has been filed

Warning: We may publicly share information about infringement notices we receive, as permitted by law. This may include publishing the notices on our website.
